Децентралізація та реформування місцевого самоврядування в сучасній Україні на основі досвіду Польщі

Abstract

У статті здійснено аналіз процесу реформування децентралізації державної влади та місцевого самоврядування в сучасній Україні на основі польського досвіду. Актуальність роботи продиктована потребами поглибленого вивчення стану та динаміки реалізації розпочатої у 2015 р. реформи. Проблематика актуалізується також необхідністю переосмислення чинників, які є істотною перешкодою для об’єднання та функціонування територіальних громад. Метою статті є визначення поточних здобутків, а також проблем, невирішених питань, можливих ризиків і перспектив процесу децентралізації та реформування місцевого самоврядування в Україні з урахуванням польського досвіду. Методологічну основу дослідження становить комплекс визнаних загальнонаукових та спеціальних методів, з-поміж яких необхідно виділити такі: порівняльний метод (для осмислення процесу децентралізації та реформування місцевого самоврядування в Україні і в Польщі); системний метод (для визначення причин, що перешкоджають процесу децентралізації державної влади, об’єднанню та функціонуванню територіальних громад в Україні); формально-юридичний метод (для осмислення нормативно- правових актів України). Зазначено, що базові нормативно-правові акти, які регламентують процес децентралізації та реформування місцевого самоврядування в сучасній Україні, спрямовані на запровадження трирівневої системи адміністративно-територіального устрою, здійснення реформи місцевого самоврядування на демократичних засадах. Визначено, що з 2014 по 2019 р. Україна, враховуючи польський досвід, досягла значного прогресу в процесі децентралізації та реформування місцевого самоврядування. Констатовано, що вагомою проблемою у питанні об’єднання та функціонування територіальних громад є, з одного боку, відсутність змін у Конституції України в частині децентралізації влади, а також закону, який би внормував питання адміністративно-територіального устрою України, з іншого – відсутність належної підтримки, а інколи і протидія з боку місцевих адміністративних і політичних еліт через побоювання втрати повноважень, можливостей регулювання фінансових потоків, впливу на громаду в питаннях прийняття рішень. The article is analyzed the process of reforming the decentralization of state power and local selfgovernment in modern Ukraine based on Polish experience. The relevance of the work is dictated by the needs of an in-depth study of the state and dynamics of implementation of the reform 2015. The issue is also being actualized by the need to rethink factors that are a significant impediment to the integration and functioning of territorial communities. The purpose of the article is identification current achievements as well as problems, unresolved issues, possible risks and prospects of the process of decentralization and reform of local self-government in Ukraine by the Polish experience. The methodological of research is a set of recognized general scientific and special methods, among which are the following: comparative method (to understand the process of decentralization and reform of local self-government in Ukraine and Poland); systematic method (to identify the reasons that impede the process of decentralization of state power and unification and functioning of territorial communities in Ukraine); formal-legal method (for comprehension of normative-legal acts of Ukraine). It is stated the basic normative legal acts which regulating the process of decentralization and reform of local self-government in modern Ukraine. They are aimed at introducing a three-tier system of administrative-territorial system and implementation of the reform of local self-government on a democratic basis. It is determined that, Ukraine has been made significant progress in the process of decentralization and reform of local self-government from 2014 to 2019 by the Polish experience. It is stated that a major problem in the issue of unification and functioning of territorial communities is the lack of changes in the Constitution of Ukraine regarding the decentralization of power on the one hand, as well as a law that would regulate the issue of the administrative and territorial structure of Ukraine, on the other, the lack of adequate support, and sometimes opposition from local administrative and political elites because of fears of loss of authority, ability to regulate financial flows, and influence on the community in decision-making matters.
