Консультативно-дорадчі органи в контексті сучасної моделі державно-церковних відносин в Україні

Abstract

The formation of civil society in modern Ukraine is an important precondition for a successful overcoming of crisis phenomena, achieving economic and cultural prosperity and strengthening the cooperation between the state and citizens. The successful outcome of this process depends on the effective and coherent operation of the main civil society institutions. Church and other religious organizations deserve special attention among them. The article analyzes the main features of church formation as an active and full-fledged institution of civil society through the system of consultative and advisory bodies in the structure of state power. Since the conditions and possibilities of performing such tasks by religious institutions depend on state policy in the religious-church sphere, it requires a detailed analysis of the main steps of the state regarding the development and implementation of legislative initiatives, aimed to ensure freedom of conscience, the activity of churches and religious organizations in Ukraine. The study of state-church relations in Ukraine during the period of independence was conducted on the basis of regulatory framework analysis that provides the legal basis for monitoring and controlling these relations, taking into account the current achievements of scientists, who worked in this thematic field. The author says that the state and level of ensuring the right of citizens to freedom of conscience, the nature of state-church relations and the use of the significant potential of the church as a social institution depend on the position of the state power, the existence of clear and understandable policies on religion and religious organizations, readiness for constructive dialogue with the religious community and mutual respect. Creation of important political and legal conditions for the formation and effective operation of advisory bodies will provide an opportunity for religious organizations to resolve urgent issues of church-religious promptly and constructively, which is extremely important for consolidation of Ukrainian society.
