Взаємодія держави та місцевого самоврядування під час воєнного стану

Abstract

У статті розглянуто теоретичні та правові засади взаємодії держави й органів місцевого самоврядування в Україні в умовах запровадження правового режиму воєнного стану. Зазначено, що конституційна модель публічної влади в Україні ґрунтується на романо-германській традиції, у межах якої поєднуються органи виконавчої влади та місцевого самоврядування. Основою сучасної системи місцевої влади є громадівська концепція самоврядування, згідно з якою воно реалізується на рівні територіальних громад. У статті наголошено, що практичне функціонування цієї моделі супроводжується низкою суперечностей: відсутністю повноцінного самоврядування на районному та обласному рівнях, дублюванням компетенцій рад і державних адміністрацій, а також відсутністю механізмів взаємного контролю між ними. The article examines the theoretical and legal foundations of the interaction between the state and local self-government bodies in Ukraine under the legal regime of martial law. It is noted that the constitutional model of public authority in Ukraine is based on the Romano-Germanic tradition, which combines the institutions of executive power and local self-government. The current system of local government relies on the community-based concept, according to which self-government is exercised at the level of territorial communities. The article emphasizes that the practical implementation of this model is accompanied by a number of contradictions: the absence of full-fledged self-government at the district and regional levels, duplication of functions between councils and state administrations, and the lack of mechanisms for mutual control between them.
