Теоретико-концептуальні виміри співвідношення різних видів суверенітету

Abstract

The formation of the state on the basis of internal cultural and historical experience is manifested primarily in the orientation of the people to the independence, autonomy and sovereignty of the state. In modern scientific political science literature, theoretical studies of national sovereignty acquire special value, because it is impossible to deny that there are practically no established and complex ideas about this phenomenon in Ukrainian science. The sovereignty of the people is not only a relatively new concept for Ukraine, but also one that still overshadows a more traditional phenomenon for our legal system – state sovereignty. At the same time, difficulties in the process of clarifying the nature of a nation’s sovereignty are associated with the need to define the meaning of the term nation and its characteristics as a carrier of sovereignty. So, in this article, the author analyzed the main scientific approaches to the essence of sovereignty and determining the place of the sovereignty of the nation state or state sovereignty among other types of sovereignty, as well as clarified the peculiarities of its relationship with the sovereignty of the nation. It is proven that sovereignty is embodied in various forms, its implementation is determined by many external and internal factors, objective and subjective. Acting as the main component of the political system of society and the main feature of a democratic state. The methodological basis of the study is based on the provisions of classical and modern political theories related to the subject of consideration, the use of a spectrum of philosophical, general scientific and specifically scientific methods of cognition, developed in socially oriented sciences, which allow to comprehensively reveal the essence of the problem. The scientific novelty of the study is a comprehensive study of the categories of national state sovereignty and state sovereignty, as well as determining their place among other types of sovereignty. Становлення держави на основі внутрішнього культурно-історичного досвіду проявляється насамперед у орієнтації народу на незалежність, автономію та суверенність держави. У сучасній науковій політологічній літературі теоретичні дослідження національного суверенітету набувають особливої цінності, адже неможливо заперечити, що в українській науці практично немає усталених і складних уявлень про це явище. Суверенітет народу – це не лише відносно нове поняття для України, але й таке, що досі затьмарює більш традиційне для нашої правової системи явище – державний суверенітет. Водночас труднощі у процесі з’ясування природи суверенітету нації пов’язані з необхідністю визначення значення терміну нація та його характеристик як носія суверенітету. Тож, у даній статі автором проаналізовано основні наукові підходи до сутності суверенітету та визначення місця суверенітету національної держави чи державного суверенітету серед інших видів суверенітету, а також з’ясовано особливості його співвідношення з суверенітетом нації. Доведено, що суверенітет втілюється у різних формах, його реалізація визначається багатьма зовнішніми та внутрішніми чинниками, об’єктивними та суб’єктивними. Виступаючи основною складовою політичної системи суспільства та головною ознакою демократичної держави. Методологічна основа дослідження заснована на положеннях класичних та сучасних політичних теорій, що стосуються предмету розгляду, використанні спектру філософських, загальнонаукових і конкретно-наукових методів пізнання, напрацьованих у суспільно орієнтованих науках, які дозволяють всебічно розкрити суть поставленої проблеми. Науковою новизною дослідження є комплексне вивчення категорій суверенітету нації, суверенітету національної держави та державного суверенітету, а також визначення їх місця серед інших видів суверенітету.
