Неформальні об’єднання в Конгресі США: досвід для України

Abstract

Стаття присвячена розгляду історії створення, організації діяльності та впливу на законодавчий процес таких неформальних об’єднань, створених у Конгресі США, як організації-члени Конгресу (Congressional Member Organizations, CMOs) в Палаті представників та неформальні групи членів у Палаті представників, Сенаті та в обох палатах Конгресу. З’ясовано, що функціонування неформальних об’єднань – явище, притаманне всім демократичним парламентам, у результаті якого обговорюються найгостріші питання політики і держави в колі однодумців. Розглянуто позитивні та негативні впливи неформальних об’єднань у парламенті на політичний процес. Визначено сучасну роль кокусів (англ. caucus) – зібрань прихильників або членів політичної партії чи політичного об’єднання. Визначено роль і значення неформальних об’єднань у діяльності обох палат Конгресу США. Встановлено, що традиційним для конгресменів США є проведення неформальних зібрань для просування спільних інтересів за межами офіційного комітету і політичних партійних систем; членство в них розглядається як засіб реалізації їхньої лобістської діяльності. Розкрито еволюцію розвитку неформальних об’єднань у Конгресі США, починаючи з 1812 року. З’ясовано, що з 60-х рр. ХХ ст. Демократична дослідницька група (DSG), Група по середам і Група позапартійних членів Конгресу за мир через право (MCPL) були єдиними неформальними групами-членами в Конгресі, які досягли стійкого статусу в рамках законодавчої організації і набули тенденції на зростання. З’ясовано, що з 80-х рр. ХХ ст. неформальні об’єднання в Конгресі США набули статусу організацій законодавчої служби (Legislative Service Organizations, LSOs), що дало їм право діяти як юридична особа на умовах правомочних (визнаних) організацій-членів (Eligible Congressional Member Organizations, ECMOs), які мають чітко визначені повноваження. Охарактеризовано категорії неформальних організацій-членів: внутрішньопартійність, особисті інтереси, промисловість, регіональний рівень, рівень штату/ округу, рівень національної меншини. Наведено приклад українського кокусу Конгресу (Congressional Ukrainian Caucus, CUC) як двопартійного об’єднання в Палаті представників Конгресу США. Метою дослідження є узагальнення наукових поглядів на проблему створення і функціонування неформальних об’єднань у Конгресі США, їх впливу на законодавчий процес та використання досвіду в діяльності Верховної Ради України. Результати аналізу можуть бути використані під час роботи Комітетів Верховної Ради України в процесі модернізації їхньої діяльності, навчальному процесі з підготовки фахівців до діяльності в представницьких органах влади різних рівнів. The article examines the history of the creation, organization, and legislative influence of informal associations established in the US Congress as Congressional Member Organizations (CMOs) in the House of Representatives and informal groups in the House of Representatives, Senate, and both chambers of Congress. It has been found that the functioning of informal associations is a phenomenon common to all democratic parliaments, as a result of which the most pressing issues of politics and the state are discussed among like-minded people. The positive and negative influences of informal associations in the parliament on the political process are considered. The modern role of caucus is defined, caucus-gatherings of supporters or members of a political party or political association. The role and significance of informal associations in the activities of both palaces of the US Congress are determined. It has been established that it is traditional for US congressmen to hold informal meetings to promote common interests outside the official committee and political party systems; membership in them is seen as a way to implementing their lobbying activities. The evolution of the development of informal associations in the US Congress from 1812 to the present is revealed. It was found that since the 60s of the twentieth century. The Democratic Research Group (DSG), the Wednesday Group and the Non-Party Members of the Congress for Peace through Law (MCPL) were the only informal members of Congress that have achieved sustainable status within the legislative organization and have grown. It was found that since the 80s of the twentieth century. Informal associations in the US Congress have acquired the status of Legislative Service Organizations (LSOs), this gave them the right to act as legal entities under the legal conditions of Eligible Congressional Member Organizations (ECMOs), which have clearly defined powers. The categories of informal member organizations are characterized – internal party affiliation, particular interests, industry, regional level, state / district level, level of national minority. Examples of the Congressional Ukrainian Caucus (CUC) as a bipartisan association in the US House of Representatives are given. The purpose of the study is to generalize scientific views on the problem of creation and functioning of informal associations in the US Congress, their impact on the legislative process and the use of experience in the activities of the Verkhovna Rada of Ukraine. The results of the analysis can be used: during the work of the Committees of the Verkhovna Rada of Ukraine in the process of modernization of their activities; in the educational process of training specialists for activities in representative bodies of different levels.
