Правовий атитюд як визначальний елемент правової свідомості: соціально-філософський аналіз

Abstract

Наукову статтю присвячено соціально-філософському аналізу правового атитюду як визначального елементу правової свідомості у контексті трансформаційних державотворчих процесів в Україні. У публікації здійснена спроба визначити поняття «правовий атитюд» як соціально-психологічного правового досвіду, розгортається на усвідомленому та неусвідомленому рівнях, здійснює регулятивну функцію стосовно правової поведінки індивіда. Досліджено механізм створення правового атитюду, його структурні елементи, та форми впливу на поведінку людей. The article is devoted to the social philosophical analysis of judicial attitude as a defining element of legal consciousness in the context of transformational processes of state-building in Ukraine. In the publication, it was attempted to define the concept of "judicial attitude" as a social attitudes towards phenomena of legal reality, which is formed on the basis of preliminary social and psychological legal experience, takes place on both conscious and unconscious levels, performs a regulatory function with respect to judicial behavior of an individual. The mechanism of legal attitude creation, its structural elements, as well as forms of judicial attitudes influence on people's behavior were investigated.
