Філософське осмислення правової культури особистості : евристичний потенціал агапелогічного підходу

Abstract

Relevance of the topic. Philosophical understanding of modern public actions involves the deepest study of the socio-ontological, ethical, political, cultural and legal foundations of social life. Therefore, the study of various aspects of spiritual life, legal culture, values, etc. is important for a deeper understanding of legal existence, in which a person can protect their humanity, embody their vocation and their right to be human. The purpose of the article is analysing the heuristic potential of the agapelogical approach and the possibility of its use in the philosophical study of the legal culture of the individual. Research methods: general scientific methods of formal logic (deduction, induction, analysis, synthesis), as well as axiological and agapelogical approaches were used. Research results. The analysis of the essential characteristics of the concept of legal culture of the individual in the philosophical discourse has been made. It is noted that the heuristic potential of the agapelogical approach to the philosophical study of the legal culture of the individual makes it possible to use the principles that more meaningfully characterize the individual as a bearer of legal culture. The features of the agapelogical approach to the legal culture of the individual are highlighted, which include: a combination of internal structures, the presence of levels, the interpenetration of internal structures and universality. The personality is analysed in the context of the systemic laws of the universe that affect a person in the tribal system, as well as the reflection of their effect on the quality of human life. The importance of the experience of a person influencing the formation of attitudes, values, qualities of a person, habits and the formation of their legal culture is emphasized. The structure of the legal culture of the individual is revealed and its components are listed, which give certainty and the ability to influence the latter due to the improvement of one of its components. It is concluded that the use of the agapelogical approach to the legal culture of the individual opens up new opportunities to analyse the integrity and harmony of the individual through the restoration of internal ties with the spirit, soul, body and allows a person to consciously go through the path of transformation from homosapiens to homohapiens. Актуальність теми. Філософське осмислення сучасних суспільних процесів передбачає глибоке дослідження соціально-онтологічних, етичних, політичних, культурних та правових основ соціального життя. Тому дослідження різних аспектів духовного життя, правової культури, цінностей, та інш. важливе для більш глибокого розуміння правового буття, в якому людина може захистити свою людяність, втілити своє покликання, своє право бути людиною. Метою статті є аналіз евристичного потенціалу агапелогічного підходу та можливості його використання до філософського дослідження правової культури особистості. Методи дослідження – використано загальнонаукові методи формальної логіки (дедукції, індукції, аналізу, синтезу), а також аксіологічний та агапелогічний підходи. Результати дослідження. Зроблено аналіз сутнісних характеристик поняття правова культура особистості у філософському дискурсі. Зазначено, що евристичний потенціал агапелогічного підходу до філософського дослідження правової культури особистості дозволяє використовувати принципи, які більш змістовно характеризують особистість як носія правової культури. Виокремлено риси агапелогічного підходу до правової культури особистості, до яких належить: поєднання внутрішніх структур, наявність рівнів, взаємопроникнення внутрішніх структур, універсальність. Проаналізовано особистість в розрізі системних законів Всесвіту, які впливають на людину в родовій системі, а також відображення їх дії на якості життя людини. Підкреслено значимість досвіду особистості, який впливає на формування установок, цінностей, якостей людини, звичок, та формування її правової культури. Розкрито структуру правової культуру особистості та перелічено їх складові, які надають визначеність та можливість впливати на останню завдяки покращенню однієї із ії складових. Зроблено висновок, що використання агапелогічного підходу до правової культури особистості відкриває нові можливості проаналізувати цілісність та гармонійність особистості через відновлення внутрішніх зв’язків з духом, душею, тілом та дозволяє людині свідомо проходити шлях трансформацій від homosapiens до homohapiens.
