Європейська хартія регіональних мов або мов меншин: науковий дискурс в Україні

Abstract

The article is devoted to the scientific discourse in the context of the European Charter of Regional or Minority Languages as a document whose main role is to protect historical regional or minority languages of Europe. Created in 1992, the Charter is still the object of many studies aimed at revealing the peculiarities of approaches to the interpretation of the text in various countries that have not only signed but also ratified the ECRML. The opinions of such scientists as: Y. Besters-Dilger, M. Moser, I. Bolman, B. Azhniuk, S. Melnyk, S. Chernychko, G. Yankovska, S. Kot, V. Radchuk, T. Halavka, V. Horbatenko, Yu. Shemshuchenko, I. Kresina, O. Stoyka and others are valuable. The purpose of the article is to analyze the pluralism of opinions of Ukrainian and foreign researchers regarding the European Charter of Regional or Minority Languages in Ukrainian realities. The tasks of the study are to outline the reasoning of scientists in the context of the content and conceptual-categorical apparatus, the peculiarities of the Ukrainian version of the translation, as well as the political and legal experience of applying the Charter in Ukraine. To implement these tasks, the article uses such methods as: analysis and synthesis, induction and deduction, pluralism, orientation-value (in the philosophical sense), scientific abstraction, retrospective modeling. It is worth mentioning that the signing and ratification of the European Charter of Regional or Minority Languages became a new condition for membership in both the European Union (1993) and the Council of Europe (1995). The first Slavic-speaking country to fulfill this condition for joining the Council of Europe in 1995 was Ukraine. Стаття присвячена науковому дискурсу в контексті Європейської хартії регіональних мов або мов меншин як документа, головна роль якого полягає в охороні історичних регіональних мов або мов меншин Європи. Створена у 1992 р. Хартія досі залишається об’єктом багатьох досліджень націлених на розкриття особливостей підходів до трактування тексту у різних країнах, що не лише підписали, а й ратифікували ЄХРМ. Цінними у дослідженні даної проблематики є думки таких науковців як: Ю. Бестерс-Дільґер, М. Мозера, І. Больман, Б. Ажнюка, С. Мельника, С. Черничко, Г. Янковської, С. Кота, В. Радчука, Т. Халавки, В. Горбатенко, Ю. Шемшученка, І. Кресіної, О. Стойка та інших. Мета статті полягає в аналізі плюралізму думок українських та іноземних дослідників щодо Європейської хартії регіональних мов або мов меншин в українських реаліях. Завданнями дослідження є окреслити міркування науковців у контексті змісту й понятійно-категоріального апарату, особливостей українського варіанту перекладу, а також політико-правового досвіду застосування Хартії в Україні. Для реалізації зазначених завдань у статті використані такі методи як: аналізу та синтезу, індукції й дедукції, плюралізму, орієнтаційно-ціннісний (у філософському розумінні), наукової абстракції, ретроспективного моделювання. Варто зазначити, що підписання та ратифікація Європейської хартії регіональних мов або мов меншин стало новою умовою набуття членства як у Європейському Союзі (1993 р.), так і в Раді Європи (1995 р.). Першою слов’яномовною країною, яка виконала дану умову при вступі до Ради Європи у 1995 р.була Україна.
