Нотаріус і нотаріат в контексті соціокультурного буття суспільства

Abstract

The article attempts to substantiate the body of the notary and, accordingly, notaries not only as people whose profession is subject to the certification of certain documents, facts of legal significance and other obligations. Having high professional legal training, extensive experience in working with people, which requires a deep understanding not only of the content of political and legal documents, but also legal awareness in general, notaries in their intellectual potential are active actors in socio cultural development. Social connection is first of all a conceptually oriented process of communication, which in the notary system is not limited only to legal categories, but in fact to the whole conceptual and categorical apparatus of social science disciplines. Only in this case the influence of culture on the relationships between people, on their behavior. Corresponding to the meaning of the word culture as a treatment of psychophysiological manifestations of character, its inherent natural volitional energy requirements of moral and ethical and ethical and legal norms, compliance with which transforms it into a rational-volitional way of life. A significant place in the article is given to the understanding of culture as a factor that goes from nature to man, and not vice versa. Therefore, the concept of the leading representative of modern philosophical anthropology E. Moren was used as an argument. Since culture as a treatment of nature and man himself directly manifests itself in labor, an expanded interpretation of Marx's definition of labor is given. Considering the semantic meaning of the term culture, we can obtain the direction of the process, which logically and organically leads to the need for conceptual definition of the content of socio-cultural phenomenon. After all, the concepts are a method of organizing human behavior as a socio-spiritual person, not a natural individual. У статті здійснюється спроба обгрунтувати орган нотаріату і, відповідно, нотаріусів не лише як людей, чия професія підпорядкована посвідченню законності певних документів, фактів що мають юридичне значення та інших зобов’язань. Маючи високу фахову правову підготовку, великий досвід роботи з людьми, яка вимагає глибокого розуміння не лише змісту політико-правових документів, але й правосвідомості загалом, нотаріуси за своїм інтелектуальним потенціалом виступають активними суб'єктами соціокультурного розвитку суспільства. Соціальний зв’язок – це насамперед понятійно спрямований процес спілкування, який в системі нотаріату не обмежується лише правовими категоріями, а фактично всім понятійно-категоріальним апаратом суспільствознавчих дисциплін. Лише в такому разі проявляється вплив культури на взаємовідносини між людьми, на їх поведінку. Що відповідає змісту самого слова культура як обробка психофізіологічних проявів характеру, властивої йому природної вольової енергії вимогами морально-етичних та етико-правових норм, дотримання яких трансформує її в розумно-вольовий спосіб життєдіяльності. Значне місце в статті приділяється розумінню культури як фактору, який йде від природи до людини, а не навпаки. Тому в якості аргументації використана концепція чільного представника сучасної філософської антропології Е. Морена. Оскільки культура як обробка природи і самої людини безпосередньо проявляє себе у трудовій діяльності, дається розширене тлумачення визначення праці К. Марксом. Розглядаючи семантичний зміст терміну культура, можна отримати напрям процесу, який логічно й органічно підводить до необхідності понятійного визначення змісту соціокультурного феномена. Адже поняття являють собою метод організації поведінки людини як соціально-духовної особистості, а не природного індивіда.
