Характеристика трансформаційних змін СОТ та їхній вплив на країни-учасниці

Abstract

Transformational changes – forms of essential properties of something. In the period of modernization, the principles and precedents of international law, international treaties acquire special significance, under the influence of their growing importance. In the process of legal globalization, the introduction and implementation of international and European legal standards in law-making, law-enforcement and law enforcement activities is intensifying. Globalization, affecting almost all subsystems and elements of the legal system, causes changes in legal policy and legal ideology, legal culture and legal awareness, which, in turn, play a significant role in the functioning and development of the legal system. Significant changes within this important area – human and civil rights and freedoms are caused by the processes of transformation of the national legal system, which receive opportunities for existence in the context of globalization. Legal policy is a product of modernization, the result of the modern state’s search for new schemes of governing legal life, which are being modernized in order to implement the principles of legality, legal equality and justice. Legal policy can act as a powerful factor in the development of the national legal system, the optimization of relations between civil society and the state, it is associated with the transformation of the implementation of national legal ideology. In the context of modernization of the legal system, the activities of WTO members are being reformed. The World Trade Organization is the only international organization that oversees the global rules of trade between countries. Today, the World Trade Organization is one of the most effective international intergovernmental organizations. The article analyzes the transformational changes of the WTO and their impact on member countries, the main directions of modernization of reforming the activities of WTO member countries, as well as the main stages of the transformational cycle of information: transformation, information and intoformation. В період модернізації принципи і прецеденти міжнародного права, міжнародних договорів набувають особливої ролі під впливом їхнього зростаючого значення. В процесі правової глобалізації активізуються впровадження й реалізація міжнародних та європейських правових стандартів у правотворчій, правореалізаційній й правозастосовній діяльності. Глобалізація, зачіпаючи практично всі підсистеми й елементи правової системи, викликає зміни у правовій політиці і правовій ідеології, правовій культурі і правосвідомості, які своєю чергою відіграють значну роль у функціонуванні і розвитку правової системи. Суттєві зміни в межах цієї важливої галузі – прав і свобод людини та громадянина, викликають процеси трансформації національної правової системи, які отримують можливості для існування в умовах глобалізації. Правова політика – породження модернізації, результат пошуку сьогоденною державою нових схем управління правового життя, які зазнають осучаснення з метою реалізації принципів законності, правової рівності та справедливості. Правова політика може виступати в якості потужного чинника розвитку національної правової системи, оптимізації відносин громадянського суспільства і держави, вона пов’язана з трансформацією реалізації національної правової ідеології. За умов модернізації правової системи відбувається реформування діяльності країн-членів Світової організації торгівлі. Світова організація торгівлі – єдина міжнародна організація, що опікується глобальними правилами торгівлі між країнами. На сьогоднішній день Світова організація торгівлі є однією з найефективніших міжнародних міжурядових організацій. У статті проаналізовано трансформаційні зміни Світової організації торгівлі та їхній вплив на країни-учасниці, основні напрями модернізації реформування діяльності країн-членів Світової організації торгівлі, а також основні етапи трансформаційного циклу інтоформації: трансформація, інтерформація та інтоформація.
