Відповідальність народних депутатів України: політико-правовий аспект

Abstract

У статті досліджено особливості регулювання етичних принципів поведінки народних депутатів України в нормативно-правових актах, їх вплив на підвищення рівня парламентської культури й авторитету парламенту. Охарактеризовано основні принципи депутатської етики народних депутатів України порівняно з основними вимогами до поведінки євродепутатів. Уточнено базові поняття дослідження – «політична еліта», «політична відповідальність», «мораль народного обранця». Акцентовано на проблемі формування ціннісних характеристик парламентарів, зокрема їх політичній відповідальності, що сприяє забезпеченню системних змін, спрямованих на перетворення України на високорозвинену цивілізовану правову державу. Розглянуто структуру відповідальності парламентаря як важливого чинника демократичного розвитку держави, визначено в ній місце політичній (професійній) і моральній (особистісній) відповідальності. Охарактеризовано відповідальність парламентаря як таку, що пов’язана із зовнішніми чинниками (соціальна, юридична) і внутрішніми чинниками – професійна (залежить від рівня освіти) і моральна (залежить від рівня культури і системи цінностей особистості). Визначено, що моральна відповідальність народного депутата є базовою і характеризує його морально-психологічний стан; її підґрунтям є політичні інтереси і потреби, політична свідомість, здатність до мобілізації політичної волі й визначення політичних цілей. Зазначено, що поведінка парламентаря має бути взірцем відповідальної моральної поведінки; окреслено її характерні ознаки. Метою наукової статті є визначення політико-правових засад відповідальності народного депутата України в умовах розвитку парламентаризму в державі, спрямованої на реалізацію демократичних цінностей. Результати аналізу можуть бути використані під час роботи органів представницької влади, зокрема Верховної Ради України, в процесі модернізації основних нормативно-правових актів, які регулюють політику демократичного розвитку держави та визначають принципи поведінки народних депутатів як народних обранців, які в системі народного представництва є відповідальними за вироблення і реалізацію загальної політики в державі. The article examines the peculiarities of regulating the ethical principles of behavior of people’s deputies of Ukraine in regulations, their impact on improving the level of parliamentary culture and authority of parliament. The basic principles of parliamentary ethics of people’s deputies of Ukraine are characterized in comparison with the basic requirements for the behavior of European MEPs. The basic concepts of the study have been clarified – such as “political elite”, “political responsibility”, °morality of the elected representative”. Attention is focused on the problem of forming the value characteristics of parliamentarians, in particular their political responsibility, which contributes to ensuring systemic changes aimed at turning Ukraine into a highly developed, civilized, legal country. The structure of the parliamentarian’s responsibility as an important factor in the democratic development of the state is considered; it defines the place of political (professional) and moral (personal) responsibility. The responsibility of a parliamentarian is described as one that is related to external factors (social, legal) and internal factors – professional (depends on the level of education) moral (depends on the level of culture and value system of the personality). It is determined that the moral responsibility of the People’s Deputy is basic and characterizes his moral and psychological state; it is based on political interests and needs, political consciousness, the ability to mobilize political will and determine political goals. The purpose of the scientific article is to determine the political and legal basis of the responsibility of the People’s Deputy of Ukraine in the development of parliamentarism in the state, aimed at the realization values of democracy. The results of the analysis can be used in the work of the bodies of representative authorities, in particular the Verkhovna Rada of Ukraine, in the process of modernizing the basic normative and legal acts which regulate the policy of democratic development of the state and determine the principles of behavior of people’s deputies as people’s choices, who in the system of people’s representation they are responsible for developing and the implementation of general policy in the state.
